The answer is that lawyers are incredibly individualized and so are cases. A lot of criminal cases call for a 2-12 years sentence but as a matter of course the first offender will nearly always get time served. So that lawyer will seem like a genius to the uninformed. So the uninformed person will then recommend the lawyer to his friend on something different and not realize that the recommendation is based on a misconception.

A divorce case also has many different elements. A case where the participants can only afford to pay $10,000 each does not call for a lawyer who is used to $50,000 a case. That lawyer won’t give the case the time or priority it needs in many cases. There is nothing worse than running out of money in the middle of litigation. A newer and cheaper lawyer will probably let you have much better credit terms than a more experienced attorney.

Lawyers are also strange about referring to other lawyers. A lot of lawyers don’t really take the time to analyze a case before a referral and either gives the case to a safe referral or someone they find enjoyable to hang out with. It’s hard to blame a lawyer who refers a $10,000 divorce to the $50,000 divorce attorney because the $50,000 attorney has an established reputation. Referring a case to the head of a bar section who’s a cool guy also is hard to get blamed for.

So that’s why in the end you have to find an attorney who thoughtfully analyzes your case, doesn’t promise the moon, and insists upfront on being paid a fair fee.
